Privacy policy

1. Scope

This policy describes how Janover Capital LLC ("Janover Capital," "we," "us") collects, uses, shares and protects information in connection with cmbs.news (the "Site"), which Janover Capital operates. It covers this Site only. Affiliated Janover businesses and third-party sites linked from here have their own policies. By using the Site you agree to this policy and to our Terms of use.

2. Information we collect

What you send through a form. The Site has four forms, and each collects only the fields listed here:

  • Refinance form (/refinance/): property name and address, approximate loan balance, maturity date, where things stand (a choice from a list), your role, your name, email, phone (optional) and anything else you type in the message box (optional). If you arrived from a loan page, the form also carries that loan's page identifier.
  • Contact form (/contact/): name, email, phone (optional) and your message.
  • Data license inquiry (/data-licensing/): name, work email, company, what you need (a choice from a list) and an optional message.
  • Loan alert sign-up (on each loan page): your email address, the loan you asked to watch, your tick of the consent box and the consent wording you agreed to. We also create a random code so a future confirmation or unsubscribe link can identify the sign-up.

Hidden fields. Every lead form also sends, without you typing them: the page you sent it from, the consent sentence shown next to the button (empty on the email-only data license form), and, on the refinance and contact forms, the campaign tags in the link that brought you to the Site and the page that referred you (kept in your browser's session storage for that visit only). A hidden "leave this empty" field catches spam robots.

What the tools do. The property lookup runs in your browser: it downloads the Site's public loan index and searches it on your device, so what you type in the search box is not sent to us. Loan pages, lists and CSV downloads are public data and collect nothing about you.

Collected automatically. Our hosting provider, Cloudflare, processes standard technical data such as IP address, approximate location derived from it, browser type and the pages requested, to deliver the Site and protect it from abuse, and keeps it in its logs. The Site runs no analytics or advertising tools.

From other sources. If you ask us to help with financing, we may receive information about you or your property from public records (including the SEC filings this Site is built from), lenders and transaction parties.

3. How we use information

We use information to answer your request; to evaluate and arrange financing you ask about; to communicate with you by email, phone and text as described in section 5; to send loan alerts you sign up for; to operate, secure and improve the Site; to comply with law and legal process; to enforce our Terms; and to detect and prevent fraud and abuse. We may use aggregated or de-identified information, which does not identify you, for any lawful purpose.

4. How we share information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share it only as follows:

  • Lenders and transaction parties, at your direction. If you ask us to pursue financing, we share deal and contact details with prospective lenders and the parties needed to evaluate or close it. We do not pass your request to lenders or anyone else without that.
  • Service providers. Cloudflare hosts the Site and runs the database (Cloudflare D1) where form submissions and alert sign-ups are stored; our email provider delivers each request to the Janover Capital team. They process it for us under obligations suited to the service.
  • Affiliates. Affiliated Janover businesses, for the purposes in this policy.
  • Professional advisors, such as lawyers, accountants and insurers, as reasonably needed.
  • Legal and safety. When we believe disclosure is required by law, subpoena or legal process, or needed to enforce our agreements or protect the rights, property or safety of Janover Capital, our clients or others.
  • Business transfers, in a merger, acquisition, financing, reorganization or sale of all or part of our business.

Nothing you send is shared with your loan's servicer, special servicer, trustee or lender unless you ask us to contact them.

5. Communications and your choices

If you send a form with a phone number, we may contact you about your request by email, phone or text, as the sentence beside the button says; consent isn't required to get help. If you send the email-only data license form, we reply by email. Reply STOP to any text to opt out, use the unsubscribe link in any marketing email, or contact us at (561) 559-4111 or hello@cmbs.news. Loan alerts are emails only: you get one confirmation email first, and every alert carries an unsubscribe link. We may still send non-promotional messages about an active request or transaction.

6. Cookies and similar technologies

The Site sets no cookies of its own. It keeps the campaign tags and referring page for your visit in your browser's session storage, which is cleared when you close the tab. Cloudflare may set a strictly necessary security cookie to protect the Site from abuse. The Site does not respond to "Do Not Track" signals; where the law requires, we honor opt-out preference signals such as Global Privacy Control, and we do not sell or share personal information for cross-context behavioral advertising in any case.

7. Data retention

We keep information as long as reasonably needed for the purposes in this policy, including transaction records, legal, tax and accounting requirements, disputes and enforcing agreements. Form submissions and alert sign-ups are stored in our Cloudflare database and deleted when no longer needed for your request or our records. When information is no longer needed, we take reasonable steps to delete or de-identify it.

8. Security

We use commercially reasonable administrative, technical and physical safeguards. No method of transmission or storage is completely secure. Please do not send Social Security numbers, account credentials, rent rolls or financial statements through the Site's forms; if a transaction needs sensitive documents, we will arrange a suitable channel.

9. Your privacy rights

Depending on where you live, you may have the right to know or access the personal information we hold about you, correct it, delete it, get a portable copy, or opt out of certain processing. Much of what we handle relates to commercial transactions and may be exempt from some state privacy laws; we honor valid requests as the law requires. Contact hello@cmbs.news or (561) 559-4111 with your name, contact details and the request. We may need to verify your identity, and we will not discriminate against you for exercising a right. Authorized agents may submit requests with proof of authorization.

10. Children

The Site is a commercial real estate finance site for adults. It is not directed to anyone under 18, and we do not knowingly collect their information. If you believe a minor has sent us information, contact us and we will delete it.

11. Users outside the United States

The Site is operated from and intended for the United States. If you use it from elsewhere, your information will be transferred to, stored and processed in the United States, where privacy laws may differ.

12. Third-party links

Loan and deal pages link to the trusts' filings on the SEC's EDGAR system (sec.gov), and the footer names janoverinsurance.com. This policy does not cover those sites; read their policies directly.

13. Changes to this policy

We may update this policy. The revised version will be posted here with a new effective date, and material changes may be highlighted on the Site. Continued use after posting means you accept it.
